Possibly. In Texas the owner is generally responsible if it knew or reasonably should have known about the danger, failed to fix it or warn you, and that caused your injury. We look at how long the hazard was there and what the staff knew.
You may still recover. Texas reduces what you receive by your share of the fault, and you can recover as long as you are not more than 50% responsible (Civil Practice and Remedies Code 33.001).
In most personal injury cases, two years from the date of the injury (Texas Civil Practice and Remedies Code 16.003). A claim against a city, a county or the state needs written notice much sooner, generally within six months (101.101), and some city charters set their own rules. Call early.
Nothing up front. We work on contingency: our fee is a share of what we recover for you, 33.3% if your case settles before we file a lawsuit and 40% if we file. If we recover nothing, you owe us no fee and no costs.
Or call (512) 555-0128, day or night. No fee unless we win.
